§ 2. Definitions
- Customer means a natural person, legal person or organisational unit that places an order in the shop.
- Consumer means a natural person who buys for a purpose not directly related to their business or profession.
- Sole trader with consumer rights means a natural person running a business who buys in connection with that business, where the contract shows that the purchase is not of a professional nature for them, in particular in light of the business activity entered in the Polish business register (CEIDG). They have the rights described in § 7 and § 8, the same as a consumer.
- Product means an item offered in the shop: hairdressing scissors, kitchen knives and accessories.
§ 3. Products and prices
- Prices are in Polish złoty (PLN) and include VAT. Delivery within Poland is free of charge.
- For products on special offer, we also show the lowest price from the 30 days before the reduction.
- Products marked “Made to order” are brought in from Japan after the order is placed. Shipping times are given in § 6.
- To buy, you need a web browser and an e-mail address. No account is required.
§ 4. Order and conclusion of the contract
- The Customer adds products to the cart, enters contact, delivery and (optionally) invoice details, accepts the terms and clicks “Order with obligation to pay”.
- After placing the order, the Customer sees its number and the payment details. We send the same information, together with the list of products, to the e-mail address provided.
- The contract of sale is concluded when the order is placed. The order confirmation e-mail and these terms record the content of the contract.
- The Customer gives true details. If the details make delivery impossible, we will contact the Customer by phone or e-mail.
§ 5. Payment
- We accept payment only by bank transfer to the account: 74 1750 0012 0000 0000 3730 5747, recipient: Salon Fryzjerski POINT Paweł Śnieżawski. The Customer enters the order number as the transfer reference.
- The Customer pays within 7 days of placing the order. If the payment does not arrive, we will send a reminder and set an additional 7-day deadline. After it expires, we may withdraw from the contract and cancel the order.
- At the Customer’s request we issue a VAT invoice. The Customer enters the invoice details in the order form.
§ 6. Delivery
- We deliver within Poland, by courier, to the address given in the order. Delivery is free of charge.
- We ship within 3–7 working days after the payment is booked. Products marked “Made to order” are shipped within 14 working days after the payment is booked. Courier delivery usually takes 1–2 working days.
- We send the Customer the tracking number by e-mail.
- When receiving the parcel, it is worth checking whether it is damaged. If it is, please write up a damage report with the courier. This does not take away any of the consumer’s rights, but it helps us sort things out faster.
§ 7. Withdrawal from the contract (returns)
- A consumer and a sole trader with consumer rights may withdraw from the contract without giving any reason within 14 days of the day they received the product.
- It is enough to send us an unequivocal statement before this deadline, e.g. by e-mail to kontakt@togiya.com.pl or by letter. You can use the withdrawal form, but it is not obligatory.
- The product must be sent to Sokolnik 17, 14-420 Młynary, Poland within 14 days of withdrawal. The Customer bears the direct cost of returning it.
- We refund all payments received within 14 days of receiving the statement, by transfer to the account the Customer paid from, unless they give another one. We may withhold the refund until we receive the product or proof that it has been sent back.
- The Customer is liable for any diminished value of the product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning. Example: you may look at the scissors and check how they sit in your hand, but cutting hair with them goes beyond such a check.
- Details and the model form are on the Returns and withdrawal page.
§ 8. Complaints
- We are liable to consumers and sole traders with consumer rights for any lack of conformity of the product with the contract that existed at the time of delivery and became apparent within 2 years of that time, under the Polish Consumer Rights Act of 30 May 2014.
- The Customer may request repair or replacement of the product. In cases provided for by law, they may also request a price reduction or withdraw from the contract.
- Complaints are best made by e-mail to kontakt@togiya.com.pl or by letter. Please describe the problem, give the order number and the solution you expect. We cover the cost of shipping the product to us and back.
- We respond to a complaint within 14 days of receiving it.
- For Customers who are neither consumers nor sole traders with consumer rights, liability under the statutory warranty is governed by the Polish Civil Code.
- TOGIYA scissors come with a 2-year guarantee against manufacturing defects. The terms are described on the Sharpening and service page. The guarantee does not exclude, limit or suspend the consumer’s rights in the event of the product’s non-conformity with the contract.
§ 9. Disputes
- A consumer may use out-of-court dispute resolution, for example by asking a municipal or district consumer ombudsman or the Provincial Inspectorate of Trade Inspection in Olsztyn for help. Information (in Polish) is available at prawakonsumenta.uokik.gov.pl.
- Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. These terms do not limit the consumer’s statutory rights.
§ 10. Personal data and changes to the terms
- The rules for processing personal data are described in the privacy policy.
- We may change these terms, for example after a change in the law or in delivery methods. Orders placed before the change are governed by the terms in force on the day the order was placed.
